These Terms of Service (“Terms”) govern your access to and use of the Poolzy mobile application and related services (“Service”) operated by Poolzy from India. By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our community standards.
1. What Poolzy is — and is not
Poolzy is a technology platform for verified professionals who share daily commutes within a trusted community. Poolzy is not a taxi service, transport operator, employer, agent, or insurer of any user.
- Hosts and riders enter into arrangements directly with each other.
- Poolzy does not control vehicles, driving conduct, routes, or timing beyond platform tools.
- Verification badges indicate checks performed on the platform — not endorsement by Poolzy, your employer, or any government authority.
2. Eligibility
You must:
- Be at least 18 years old
- Be a working professional using the Service for commute cost-sharing, not commercial passenger transport
- Have legal capacity to enter a binding contract under Indian law
- Provide accurate, current information and keep verification details up to date
3. Accounts, verification & Poolzy Plus
To search, book, or host rides, you must generally:
- Verify your mobile number (OTP sign-in)
- Verify a work email address (personal email domains such as Gmail/Yahoo/Outlook are not accepted, except where explicitly permitted for testing)
- Maintain an active Poolzy Plus subscription, pilot grant, or referral waiver period
We may change verification requirements or participation rules. You may be asked to re-verify when our verification policy updates.
Poolzy Plus is a platform subscription that unlocks search, booking, and hosting features. It is billed separately from ride contributions between users. Current pricing, GST, and billing period are shown in the app at purchase.
4. Host responsibilities
If you publish rides as a host, you represent and agree that:
- You hold a valid driving licence and comply with all applicable motor-vehicle laws
- Your vehicle is roadworthy, insured, and registered as required by law
- You share rides for commute cost-sharing — not as commercial hire or taxi service
- Ride details (route, timing, seats, fare) are accurate
- You drive safely, respect traffic laws, and treat riders respectfully
- Vehicle information you provide (model, registration) is truthful
- You will confirm or dispute peer-to-peer payments honestly and promptly
5. Rider responsibilities
If you book rides as a rider, you agree to:
- Be ready at agreed pickup points and communicate delays promptly via in-app chat
- Pay the agreed ride contribution to the host via UPI or other method agreed between parties
- Mark payment in the app when sent and provide an accurate UPI reference if requested
- Respect the host, vehicle, and other passengers
- Follow our community standards and applicable law
6. Ride booking, payments & disputes
6.1 Booking flow
Riders send booking requests; hosts accept or reject. Upon acceptance, contact details may be shared to coordinate the commute. Bookings progress through statuses shown in the app (e.g. pending, accepted, payment marked, confirmed, completed).
6.2 Ride payments (peer-to-peer)
- Ride contributions are paid directly between rider and host, typically via UPI to the host’s declared VPA.
- Poolzy does not collect ride fares and does not guarantee payment completion.
- Poolzy’s platform service fee on rides is currently ₹0; platform revenue comes from Poolzy Plus subscriptions.
- If a rider marks payment sent, the host should confirm receipt. If the host does not respond within approximately 24 hours, the app may auto-confirm payment status as described in-product.
- Accepted bookings may expire if payment is not completed within the timeframe shown in the app.
6.3 Payment disputes
Either party may record a payment dispute in the app. Poolzy may review disputes for platform integrity but is not a payment intermediary and does not arbitrate UPI transactions between users.
7. Poolzy Plus subscriptions (Razorpay)
- Subscription fees are processed by Razorpay via UPI or other methods Razorpay supports.
- Prices may include applicable GST as shown at checkout.
- Subscriptions renew monthly unless cancelled before the renewal date shown in the app.
- Refunds are handled in accordance with applicable consumer protection law and our support policies. Contact poolzy.in@gmail.com for billing issues.
- Referral waiver months, if earned, are applied as described in the referral program rules in-app.
8. Cancellations, no-shows & trust scores
8.1 Cancellations
Either party may cancel in accordance with in-app controls. Late cancellations may affect your trust score:
- 12+ hours before departure: −2 reliability points
- 2–12 hours before departure: −5 reliability points
- Under 2 hours before departure: −10 reliability points
Hosts cancelling rides may cascade cancellations to open booking requests.
8.2 No-shows
Failure to appear without timely cancellation may result in significant trust score penalties (including −10 reliability points) and account restrictions.
8.3 Trust scores
Trust scores are automated indicators based on platform activity (completions, cancellations, feedback, profile completeness). They are not guarantees of safety, character, or driving ability. You may submit trust disputes through in-app support; we review but do not guarantee reversal.
9. Referral program
Referral codes, qualification rules, and waiver rewards are described in the app. By participating you agree that:
- Referrals must be genuine; self-referrals, fake accounts, or abuse may void rewards
- New users must apply a referral code within the window shown in the app (typically 48 hours after signup)
- Rewards are earned when referred users complete their first qualifying commute
- Poolzy may modify or terminate the referral program at any time
10. Markets & service areas
Poolzy may launch city-by-city. Some markets may be waitlisted or disabled. You may generally book or host daily commutes only within your home market and supported service corridors, as enforced in the app. Cross-market daily booking may be restricted.
11. Women-only rides
Where offered, women-only ride filters rely on optional gender information you provide. You agree not to misrepresent eligibility. Poolzy does not independently verify gender identity.
12. User content & conduct
You are responsible for chat messages, feedback, and other content you submit. You agree not to:
- Harass, threaten, discriminate against, or endanger others
- Provide false identity, vehicle, or payment information
- Use the Service for commercial taxi operations, spam, or fraud
- Circumvent verification, payment, or trust systems
- Reverse engineer, scrape, or overload the Service
- Violate applicable law
We may remove content, restrict features, or suspend accounts for violations.
13. Safety center & emergencies
Poolzy offers optional safety tools in the Safety center. They do not replace emergency services. In an emergency, call 112 (India) or your local emergency number first.
- Emergency contact (optional): you may add a trusted contact name and phone number in Edit Profile. Poolzy stores this to show it to you in Safety center.
- Call: Safety center may open your phone’s dialer to call your saved contact. The call is placed by you through your mobile carrier — Poolzy does not place calls on your behalf.
- SMS alert: Safety center may open your phone’s SMS app with a pre-filled message to your saved contact. You must tap Send to deliver the message. Poolzy does not send SMS server-side and cannot guarantee delivery.
- No live tracking: the current app version does not provide continuous live GPS tracking or external trip-share links. Route and place information comes from addresses and points you or other users enter for matching and coordination.
14. Intellectual property
Poolzy, its logos, app design, and software are owned by Poolzy or its licensors. You receive a limited, non-exclusive, revocable licence to use the app for personal commute purposes. You may not copy, modify, or distribute the Service without permission.
15. Third-party services
The Service integrates third parties including Google (Firebase, Maps), Razorpay, and email providers. Your use of those services may be subject to their terms. Poolzy is not responsible for third-party outages or actions.
16. Suspension & termination
We may suspend or terminate your account immediately if you breach these Terms, pose a safety or fraud risk, or if required by law. You may delete your account in Settings at any time, subject to completing or cancelling active ride commitments as described in our Privacy Policy.
17. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. POOLZY DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.
POOLZY DOES NOT GUARANTEE THE CONDUCT, IDENTITY, LICENCE STATUS, INSURANCE, OR VEHICLE CONDITION OF ANY USER.
18. Limitation of liability
To the maximum extent permitted by law, Poolzy and its affiliates, officers, and employees shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from:
- Your use of or inability to use the Service
- Any ride, accident, injury, delay, or dispute between users
- Unauthorized access to your account where not caused by Poolzy’s gross negligence
- Third-party services or payment failures between users
- Failure of call, SMS, or other device-level safety actions you initiate
Nothing in these Terms limits liability that cannot be excluded under applicable Indian consumer protection law.
19. Indemnity
You agree to indemnify and hold harmless Poolzy from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your rides, your content, or your violation of these Terms or applicable law.
20. Changes to Terms
We may update these Terms. Material changes will be communicated in-app or by other reasonable means. Continued use after the effective date constitutes acceptance where permitted by law.
21. Governing law & disputes
These Terms are governed by the laws of India. Courts at Pune, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer protection remedies and mandatory arbitration provisions under Indian law where applicable.
